A discussion of the regulatory framework with respect to
online gambling in Greece, has to start with a consideration of overarching
EU law which dictates that EU members should not
engage in protectionist practices with regard to service provision.
According to the European Commission (EC) and European Court of Justice (ECJ)
rulings, the freedom to provide services provisions of EU law do apply to online
gambling services, meaning that where a country offers a locally based online
gambling product (state run lottery etc), it cannot ban access by residents to
similar services provided by other EU members.
Despite the EC position, a number of EU members have sought
to ban online gambling in some form or another and Greece is one of them.
In February 2009 a Greek court told UK sports book Stanleybet, to shut its
operations in Greece. Greece's prohibitive stance toward online gambling
has lead to the EC issuing them with a “reasoned opinion” arguing that
they are in breach of European law. EC infringement proceedings against
other countries, like France have lead to new licensing and regulation laws
being developed to open up online gambling markets, and Greece and other
countries in breach may follow suit.
