Background
Italian authorities originally went down the prohibition path
with regard to online gambling. The laws made the organising of games of
chance or the collecting of bets from Italian residents in the absence of local
police authorisation illegal and rogue operators faced criminal penalties.
In March 2007 this law, as it applied to online gambling operators was deemed by
the European Court of Justice ("ECJ") to be a breach of EU law, in case brought
by sports betting giant Stanley Leisure plc.
The ECJ ruled that Italy cannot use criminal law to stop
gaming companies licensed in another EU member nation from taking bets from
Italians and that such restrictions are incompatible with European Community
principles. Italy, like a number of other EU members whose protectionist
laws have attracted ECJ or European Commission scrutiny, went back to the
drawing board to change their approach to online gambling.
Italy now has a fully operational remote gambling regulation
system managed by
State Monopolies Authority (Amministrazione Autonoma
Monopoli di Stato - "AAMS"), and a number of operators (60+ as at April
2011) have been awarded online gambling licenses.
Under the regulations, licensed operators are able to provide
casino games of chance online, subject to having their gaming platform and
gaming software duly certified by an AAMS-accredited testing house.
Therefore, in the case of online casino operators offering live dealer games, in
addition to holding a remote gaming license, their chosen platform (Evolution
Gambling,
Playtech, Microgaming, etc)
must be AAMS tested and approved.
In May 2011,
Evolution Gaming became the first live gaming platform to be officially
certified by Italy's AAMS. Their games can now be to be provided to
Italians via locally licensed operators including 888.com and will include
Venezia Roulette - single zero roulette with Italian speaking dealers and
tailored to the local playing market.
Shortly afterward, a bunch of casino operators announced
they'd been awarded AAMS licenses to operate in Italy:
