Gibraltar challenges UK POC tax in High Court

The UK's soon to be implemented online gambling point of consumption tax is being challenged in the High Court by the Gibraltar Betting and Gaming Association (GBGA)

The GBGA are contending the new regime is unlawful as it is:

disproportionate and discriminatory interference with the European Union's right to free movement of services

They've also requested an expedited hearing, given the law comes into effect within months

The UK Gambling Act 2014 has been postponed and will not now come into force on October 1 as planned.

A statement from the UK Gambling Commision reads...

Due to a High Court challenge to the Gambling (Licensing and Advertising) Act 2014, [the Department of Culture Media and Sport] will be taking the necessary steps to postpone this legislation coming into force until November 1, 2014.

A high Court decision on GBGA's challenge is expected this week.

Lord Justice Green will hand down judgment on Friday according to media reports.

The court appeal brought by GBGA was dismissed by British High Court Justice Green on Friday. He said...

Parliament was clearly within its rights to act as it did.

As such the the new Gambling Bill comes into force on November 1, 2014.

The GBGA released this statement following the judgement:

We remain concerned the UK regulator will find it difficult to hold companies to account in jurisdictions outside of the EU where it has no legal powers and common legal framework or culture.
